This is my take on whether or not the Individual Mandate is constitutional. It is most certainly within the constitution for the Individual Mandate to exist. This power is under the same powers by which the government may regulate food, water or air.
The thing that gets lost is that I personally do not agree with the Individual Mandate. I believe it to be wrong, and in my opinion, it doesn't address the problem. The issue is not that people do not buy insurance, it is that they cannot afford it. Still, you can not say the Individual Mandate is unconstitutional.
